risperdalIn the first jury verdict of its kind, a Philadelphia jury has come back with a $2.5 million award for a man who was prescribed Risperdal® for five years in the 2000s. Attorneys for the plaintiff argued that Johnson & Johnson, the parent company of Risperdal manufacturer Janssen Pharmaceuticals, engaged in deceptive marketing practices that targeted pediatricians and pediatric neurosurgeons.

The company was accused of failing to warn patients and their doctors about dangerous side effects of the drug. The plaintiff in the case developed Gynecomastia. This condition causes abnormal breast tissue growth in some boys who take Risperdal.

Witnesses at the trial testified that the large pharmaceutical company knew about the risks, intentionally played down the side effects, and targeted children’s doctors in their marketing campaigns.

Not FDA Approved for Use in Children

While Risperdal was only initially approved for use in adults, in 2006 the U.S. Food and Drug Administration approved the drug to be used in kids suffering from autism. At the time, the label was changed to indicate the risk of breast tissue development.

However, the plaintiff in the case was first prescribed Risperdal in 2002, long before the drug was approved for use in children. At the time, he was still in elementary school. Through the course of his five years of treatment, the plaintiff developed 46 DD breasts.

In addition to losing the civil lawsuit in Philadelphia and settling other similar cases, Johnson & Johnson has also pled guilty to criminal charges.

In 2013, the company pled guilty under the federal False Claims Act for marketing Risperdal and other drugs to doctors and patients on an off-label use basis.

In that case, the company was fined more than $2.2 billion by the Department of Justice. In order to get doctors to prescribe Risperdal to children, before it was approved for use in kids, the company offered doctors illegal incentives and kickbacks.
